§ 1. General provisions

These Terms and Conditions set out the rules governing the sale of limited-edition, numbered and signed art prints (giclée prints) through the online shop available at www.rodowicz.art (hereinafter: the “Gallery”).

The Gallery is an artist-run gallery. The seller is the artist in person: Antoni Rodowicz, operating at the address: www.rodowicz.art, e-mail: antoni@rodowicz.art (hereinafter: the “Artist” or the “Seller”).

The Artist may be contacted electronically at the e-mail address indicated above.

The Terms and Conditions are addressed both to consumers and to businesses using the Gallery, unless a given provision states otherwise.

§ 2. Definitions

Artwork – a limited-edition art print, numbered and hand-signed by the Artist, produced using the giclée technique (high-quality pigment printing on archival paper), constituting, from the perspective of the art market, a unique copy within a defined edition.

Customer – a natural person, legal person or organisational unit making a purchase in the Gallery.

Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity; provisions concerning the Consumer also apply to a natural person conducting business activity where the purchase is not of a professional nature for them.

Personalised Artwork – an Artwork bearing, at the Customer’s request, an individual, named dedication by the Artist, or produced according to other individual specifications of the Customer.

§ 3. Nature of the Artworks

Each Artwork forms part of a limited edition, the size of which is stated in the Artwork’s description. Once the edition is sold out, the Artwork will not be reprinted.

Each copy is numbered (e.g. 3/30) and hand-signed by the Artist.

The print is produced to the Customer’s individual order, after the order is placed, at a professional giclée printing studio in France.

Photographs of the Artworks in the Gallery are for illustration purposes. Due to the specific nature of fine-art printing and differences in screen calibration, the actual colours of the print may differ slightly from those displayed on screen. Such differences do not constitute a defect of the Artwork.

Purchasing an Artwork means acquiring ownership of the copy. The purchase does not transfer any author’s economic rights to the Customer and does not grant any licence — in particular, the Customer is not entitled to reproduce, distribute or commercially exploit the image of the Artwork without the Artist’s separate written consent.

§ 4. Placing orders and conclusion of the contract

Orders may be placed through the Gallery 7 days a week, 24 hours a day.

To place an order, the Customer selects the Artwork, provides the data necessary to fulfil the order (full name, delivery address, e-mail address) and makes payment.

When placing an order, the Customer may request an individual dedication by the Artist (Personalised Artwork). The request should be made in the order notes field or by e-mail immediately after placing the order.

The sales contract is concluded when the Customer receives an e-mail confirmation that the order has been accepted for fulfilment.

Placing an order is conditional upon acceptance of these Terms and Conditions.

§ 5. Prices and payments

Prices of the Artworks are quoted in euro (EUR) and are final prices. The Seller benefits from a VAT exemption; therefore, prices do not include VAT and no VAT is added.

A shipping cost of EUR 30 is added to the price of the Artwork and is visible before the order is placed.

Payments are processed by the operator Stripe (Stripe, Inc. / Stripe Payments Europe Ltd.), supporting card payments and other methods made available at checkout.

The Customer pays in advance, at the time of placing the order. Failure to pay means no contract is concluded.

At the Customer’s request, the Seller issues a receipt/invoice without VAT.

§ 6. Order fulfilment and delivery

As each print is made to order, the fulfilment time (preparation of the Artwork and handover to the carrier) is 5 to 21 business days from the date the payment is credited. The Customer is notified of dispatch by e-mail.

Delivery is provided within Europe by reputable carriers, in packaging protecting the Artwork during transport. Parcels are dispatched from the territory of France.

The estimated carrier delivery time is usually 2–7 business days from dispatch, depending on the destination country.

Where possible, the Customer should check the condition of the parcel upon receipt. In the event of visible damage to the packaging, it is recommended to draw up a damage report with the carrier and to contact the Artist immediately — this will facilitate the handling of a complaint, but is not a condition for making one.

§ 7. Right of withdrawal

The Consumer has the right to withdraw from the contract within 14 days of taking possession of the Artwork, without giving any reason.

The right of withdrawal does not apply to a Personalised Artwork — i.e. one bearing, at the Customer’s request, a named dedication or produced according to the Customer’s individual specifications (Article 38(3) of the Polish Consumer Rights Act of 30 May 2014). The Customer is informed of this before placing an order with the personalisation option.

To withdraw from the contract, the Consumer submits an unequivocal statement to the Artist (by e-mail or in writing), for example using the form attached to the Terms and Conditions. Sending the statement before the deadline expires is sufficient to meet it.

The Consumer shall return the Artwork without undue delay, no later than 14 days from the date of the withdrawal statement, to the address indicated by the Artist. The direct costs of returning the Artwork (including appropriate packaging and shipment insurance) are borne by the Consumer. Given the nature of the Artwork, these costs may exceed those of standard postal delivery.

The Consumer is liable for any diminished value of the Artwork resulting from handling beyond what is necessary to establish its nature, characteristics and functioning (e.g. damage, creases, framing marks, soiling, removal of protective elements).

The Artist shall refund all payments received from the Consumer, including the original shipping cost, without undue delay and no later than 14 days from receipt of the withdrawal statement, and may withhold the refund until the Artwork has been received back or proof of its return shipment has been provided. The refund is made using the same payment method used by the Consumer.

The right of withdrawal referred to in this section does not apply to Customers who are not Consumers.

§ 8. Complaints (non-conformity of the Artwork with the contract)

The Artist is obliged to deliver an Artwork free from defects and in conformity with the contract.

In the event of the Artwork’s non-conformity with the contract, the Consumer is entitled to the remedies provided for in the Consumer Rights Act (Chapter 5a), in particular the right to demand replacement and, where this is impossible or excessively difficult, a price reduction or withdrawal from the contract. The Artist is liable for non-conformity existing at the time of delivery and revealed within two years of delivery.

The following do not constitute non-conformity with the contract: slight colour differences resulting from screen calibration (§ 3(4)), natural characteristics of fine-art paper, or characteristics expressly indicated in the Artwork’s description.

Complaints may be submitted by e-mail to the address indicated in § 1, together with a description of the non-conformity and, where possible, photographs. The Artist will respond to the complaint within 14 days of its receipt.

With respect to Customers who are not Consumers, liability under statutory warranty is excluded to the fullest extent permitted by law.

§ 9. Personal data

The controller of Customers’ personal data is the Artist.

Data are processed for the purposes of fulfilling orders, handling complaints and performing legal obligations, in accordance with the GDPR (Regulation (EU) 2016/679).

Detailed information on data processing is provided in the Privacy Policy available in the Gallery.

Payments are processed by Stripe, which is a separate data controller with respect to payment data.

§ 10. Copyright

All works and content presented in the Gallery (images, texts, photographs) are protected by copyright and constitute the intellectual property of the Artist.

Copying, reproducing and distributing the Gallery’s content without the Artist’s consent is prohibited, except for permitted personal use.

§ 11. Out-of-court dispute resolution

The Artist endeavours to resolve any disputes amicably, primarily through direct contact.

The Consumer may use out-of-court means of handling complaints and pursuing claims, including the assistance of the municipal (district) consumer ombudsman, consumer organisations, and the permanent consumer arbitration courts operating under the Trade Inspection. Detailed information is available on the website of UOKiK (www.uokik.gov.pl).

§ 12. Final provisions

Contracts concluded through the Gallery are governed by Polish law, in particular the provisions of the Civil Code and the Consumer Rights Act of 30 May 2014. The choice of Polish law does not deprive the Consumer of the protection afforded by provisions that cannot be derogated from by contract under the law of the country of the Consumer’s habitual residence.

In matters not regulated herein, the provisions of the Civil Code, the Consumer Rights Act and other applicable laws shall apply.

The Artist may amend the Terms and Conditions for important reasons (e.g. changes in the law, delivery or payment rules). Amendments do not apply to orders placed before their entry into force.

The Terms and Conditions are drawn up in Polish, French and English versions. The foreign-language versions are for information purposes; in the event of any discrepancy, the Polish version shall prevail.

The Terms and Conditions are effective as of 26.06.2026.
